The Insane Avatar Copyright Lawsuit Filed Against James Cameron

Author Kelly Van claims that James Cameron's record-breaking sci-fi epic Avatar is based on her unpublished book Sheila the Warrior: the Damned, an action romance set on the planet of "Tibet." Hmmm. We have the full lawsuit.

No one tell Kelly Van about Pocahontas! The author, whose book seems to have never been professionally published, outlines her claims below in the categories of "Plot," "Characters" (sub-categories: "Physique," "Demeanor," "Attire," "Emotions," and "Powers/Rituals"), "Setting" and "Scenes."

In Sheila the Warrior: the Damned, two women travel to a planet called "Tibet," "where food tastes better than you can imagine" and "the concept of 'killing' is foreign." There they meet fantastic species like "Crowmen" and "bloodsuckers." They even fall in love with some of them them! There is action and adventure ("Claire" fights a "waterian"), and all in all it sounds like a cracking good read. It does not, however, sound very much like Avatar.

But you can decide for yourself. The full lawsuit is below:

Not sure what to make of this.

Sad Trombone

...

People... just are so dumb...
They think they're gonna get even CLOSE to winning a lawsuit like that? Their storys don't even seem all that similar!

Date of creation:

Sheila The Warrior: 1999-00

James Cameron's Avatar: 1994-95

Fail.

Two or three other copyright lawsuits have been filed and none of them have actually gone through. Such a waste of time.

Sounds like someone was looking for a quick buck... Perhaps this was a publicity stunt, though -- they're getting free advertising, even though the lawsuit itself is probably frivolous at best. They might make front-page news on some news outlets for a few hours, at least, which can't hurt their sales...

That would be one incentive to pointlessly try and sue Avatar, to get attention but she hasnt published her book (I dont think) so the lawsuit really does seem fruitless.

But even us just talking about it in this thread is free advertising for her.

the author needs to take her fail wither her and GTFO :D

Woodsprite 05-19-2010 09:43 AM

Well this is embarrassing...

...for the prosecution.

Fkeu'itan 05-19-2010 10:27 AM

Just... what?

There have been certain cases where i've looked at the case for prosecution and thought that there was somewhat of a similiarity in character appearance or storyline etc. (Not saying there was a strong case for a claim, but there was a reasonable comparison none the less) but this doesn't even share the most tenuous of links with Avatar.

It's sad that some people feel the need to shamelessly attempt to capitalise on such a wonderful thing...

It's amazing how much money matters to some, isn't it? :D

See, I doodled this picture on a used napkin a few years back...

It looks a lot like one of the plants from Avatar! GIMME MONEIZ!

Light Kirin 05-19-2010 03:25 PM

Well, she's doing a good job of embarrassing herself. Her story sounds nothing at all like Avatar.

When the take from a film is in excess of a billyun buckeroos, you walk around with a great big sign around your neck that says SUE ME!!!! That's why JC and 20th Century Fox retain lawyers, and why lawyers drive nice cars. Ah....capitalism at it's finest. (jk)

;)

well, to be fair, lawyers sink a good portion of their life in schooling to do just that.
