The Insane Avatar Copyright Lawsuit Filed Against James Cameron

Author Kelly Van claims that James Cameron's record-breaking sci-fi epic Avatar is based on her unpublished book Sheila the Warrior: the Damned, an action romance set on the planet of "Tibet." Hmmm. We have the full lawsuit.

No one tell Kelly Van about Pocahontas! The author, whose book seems to have never been professionally published, outlines her claims below in the categories of "Plot," "Characters" (sub-categories: "Physique," "Demeanor," "Attire," "Emotions," and "Powers/Rituals"), "Setting" and "Scenes."

In Sheila the Warrior: the Damned, two women travel to a planet called "Tibet," "where food tastes better than you can imagine" and "the concept of 'killing' is foreign." There they meet fantastic species like "Crowmen" and "bloodsuckers." They even fall in love with some of them them! There is action and adventure ("Claire" fights a "waterian"), and all in all it sounds like a cracking good read. It does not, however, sound very much like Avatar.

But you can decide for yourself. The full lawsuit is below:

Not sure what to make of this.

Sad Trombone

...

People... just are so dumb...
They think they're gonna get even CLOSE to winning a lawsuit like that? Their storys don't even seem all that similar!

Date of creation:

Sheila The Warrior: 1999-00

James Cameron's Avatar: 1994-95

Fail.

Vauktu 05-19-2010 07:58 AM

Two or three other copyright lawsuits have been filed and none of them have actually gone through. Such a waste of time.

Sounds like someone was looking for a quick buck... Perhaps this was a publicity stunt, though -- they're getting free advertising, even though the lawsuit itself is probably frivolous at best. They might make front-page news on some news outlets for a few hours, at least, which can't hurt their sales...

That would be one incentive to pointlessly try and sue Avatar, to get attention but she hasnt published her book (I dont think) so the lawsuit really does seem fruitless.

But even us just talking about it in this thread is free advertising for her.

tm20 05-19-2010 08:21 AM

the author needs to take her fail wither her and GTFO :D

Woodsprite 05-19-2010 09:43 AM

Well this is embarrassing...

...for the prosecution.

Fkeu'itan 05-19-2010 10:27 AM

Just... what?

There have been certain cases where i've looked at the case for prosecution and thought that there was somewhat of a similiarity in character appearance or storyline etc. (Not saying there was a strong case for a claim, but there was a reasonable comparison none the less) but this doesn't even share the most tenuous of links with Avatar.

It's sad that some people feel the need to shamelessly attempt to capitalise on such a wonderful thing...

It's amazing how much money matters to some, isn't it? :D

See, I doodled this picture on a used napkin a few years back...

It looks a lot like one of the plants from Avatar! GIMME MONEIZ!

Light Kirin 05-19-2010 03:25 PM

Well, she's doing a good job of embarrassing herself. Her story sounds nothing at all like Avatar.

Taw Makto 05-19-2010 03:27 PM

When the take from a film is in excess of a billyun buckeroos, you walk around with a great big sign around your neck that says SUE ME!!!! That's why JC and 20th Century Fox retain lawyers, and why lawyers drive nice cars. Ah....capitalism at it's finest. (jk)

;)

well, to be fair, lawyers sink a good portion of their life in schooling to do just that.

Yep. And there's a saying that lawyers are pretty much just hired guns.

utter fail

Stanley_9875 05-19-2010 05:03 PM

A) she's looking for attention
B) she's looking for attention for her book
C) she can't pay for publishing rights for her book so she sues someone with lots of money
D) all the above

skxawng, seriously, I feel bad for JC because of all the crap he has to go through after making the most epic movie of all time

Read C. 05-19-2010 05:58 PM

I googled "james cameron lawsuit" and apparently other people have been trying to press charges against JC.

It's pathetic.

nickneagle 05-20-2010 11:40 AM

Story sounds nothing like it. I am sure it will fight out in court for a while though.

Ay'iheyu 05-20-2010 03:56 PM

This is so sad. Anyone who creates a successful movie, book, album etc. is bound to get sued by some idiot who claims they thought of it first.

Awww I miss Avery... the one who put together the CFFP Part 1 and 2. He was a great guy... is he still around there?

Isard 05-22-2010 04:55 PM

Sammich?

um...

I haven't seen him on skype in awhile.

That woman should be ashamed.

And yeah, I know it's been said before- But she's just looking to make some advertising.

Also... What 'author' would name their damn planet Tibet? Way to alienate an entire country if you don't represent it as the best place in the universe.

You can copyright characters (names) and things of that nature, but you can't copyright ideas and emotions (Travel to planet and do this, find love, etc). Otherwise it would have been done and there would not be any new art or form of entertainment, because that's way too broad.

Wow, glad to see someone else who loves Tali here! She'd better be back in ME3- I'm sure she'll be a squaddie, as about 60% of the ME fan base will create a storm of epic proportions if she isn't.

EywaBlessMe 06-02-2010 10:45 PM

Let's see... a book no one's ever read because it hasn't been published is being plagiarized?:gconfused::gconfused::gconfused:

Patrice Maire 06-10-2010 06:44 AM

I didn't read anything other than the quick line about a female author... can someone do some looking and see if it's the same nutball lady that tried to sue the brothers who made the Matrix movies? She didn't take them to court until after the third movie was done!
Nut case... her story wasn't published either, it was a 'script' that she had shown to WB supposedly and claimed they ripped it off. Riiiiight... talk about an alternate reality!
If anyone has a case against Cameron its about five other filmmakers who came before him with similar plotlines. She doesn't have a case and will get thrown out before anything happens.

The Matrix lawsuit was filed by a woman named Sophie Stewart I believe. If I find a link to that story Ill add it to this post.

I hate money grubbers. U want a successful script, make your own. I notice that I never hear about a movie that bombs having a lawsuit filed against it, just successful ones. Its Madness I say!
